These Affiliate Program Terms & Conditions govern participation in the My Devilish Desires affiliate program operated by My Devilish Desires Ltd ("My Devilish Desires", "we", "us", or "our"). By applying to or participating in the program, you agree to these Terms & Conditions.

To participate in the program, you must be at least 18 years old; provide accurate application and payment information; be approved by My Devilish Desires; and comply with all applicable laws, platform rules, and these Terms & Conditions. We reserve the right to approve or reject any affiliate application at our sole discretion.

All approved affiliates join the program at the Temptress tier unless otherwise agreed by us in writing. Affiliate tiers are: Devilish Recruit - 10% commission on monthly tracked net sales of $0-$999; Devilish Muse - 15% commission on $1,000-$2,999; Devil’s Inner Circle - 20% commission on $3,000+. Tier upgrades are applied from the following calendar month after the qualifying threshold is achieved. Once a higher tier is reached, that tier will usually be retained for 3 calendar months, after which performance may be reassessed.

Commission is calculated on Tracked Net Sales only. Tracked Net Sales means the final order value successfully tracked through your unique affiliate link, QR code, or discount code, after discounts and promotional reductions, excluding shipping fees, taxes, duties, refunded orders, cancelled orders, reversals, chargebacks, duplicates, fraudulent transactions, and self-referred transactions. If a sale is not successfully tracked to your approved affiliate link or code, no commission will be payable on that sale.

Approved affiliates will be issued a unique affiliate link, code, or both. You must only use links and codes assigned or approved by My Devilish Desires. You may not alter, copy, or interfere with another affiliate’s tracking, present another affiliate’s code as your own, use unapproved redirects, cloaking, or tracking manipulation, or claim commission on orders not genuinely generated by your promotional activity. We reserve the right to determine final attribution of any sale where there is a dispute, tracking issue, or suspected misuse.

My Devilish Desires may provide customer discount codes linked to affiliate promotions. Discount values, campaign dates, exclusions, and product eligibility may be amended at any time. Affiliate discount codes must not be represented as permanent unless expressly approved, must not be posted on coupon or voucher websites without written permission, and must not be altered, combined, or stacked unless allowed by us.

Commissions are paid in US Dollars (USD). The minimum payout threshold is $50 USD. If your approved commission balance is below $50 at the time of payment processing, it will roll forward to the next payment period until the threshold is reached. Commission payments are normally made monthly in arrears, subject to validation, fraud checks, refund windows, and receipt of correct payment details from you. We may withhold, delay, offset, or reverse commission where we reasonably believe a transaction is fraudulent or invalid, an order is refunded, cancelled, or charged back, these Terms & Conditions have been breached, or a compliance review is required.

Where an affiliate or host promotes My Devilish Desires through a Devilish Party, social, in-person event, or hosted gathering, commission will only be paid on qualifying sales correctly tracked to the host’s assigned code, QR code, or affiliate link. Untracked sales, cash sales, verbal referrals without code usage, or disputed event sales will not qualify unless approved by us in writing. Unless otherwise stated by us, party-linked commission applies only to purchases made during the event and for 7 days after the event using the assigned party code or link. Event hosts must not make promises, claims, offers, or guarantees on behalf of the brand unless approved by us.

As an affiliate, you agree to promote My Devilish Desires professionally, honestly, and in a way that aligns with our brand values. You must not engage in spam, unsolicited messages, or aggressive outreach; make false, exaggerated, misleading, or unsubstantiated claims; make medical, therapeutic, or guaranteed outcome claims unless expressly approved; impersonate My Devilish Desires or suggest you are employed by us unless you are; bid on our brand name, trade marks, or obvious variations in paid search advertising without written permission; use deceptive pop-ups, spyware, cookie stuffing, forced clicks, or similar tactics; post our offers on unauthorised coupon, cashback, or deal sites; use content that is unlawful, offensive, discriminatory, or damaging to our reputation; or target or market to anyone under the age of 18.

Because My Devilish Desires operates in the adult and sexual wellness space, affiliates are solely responsible for ensuring that their promotional content complies with local laws and regulations in the territories where they market, platform-specific advertising and community rules, and any age-restriction, content-warning, or audience eligibility requirements. We reserve the right to require removal or amendment of any promotional content that we believe creates legal, compliance, or reputational risk.

You must clearly and prominently disclose your relationship with My Devilish Desires whenever you promote our products, links, codes, or events. This applies to posts, captions, stories, live streams, videos, blogs, emails, landing pages, and event promotions. Acceptable disclosures include clear labels such as Ad, Advertisement, Paid Partnership, Affiliate Link, or I earn commission from purchases made using my code/link. Disclosures must be easy to notice and understand. Hidden, vague, or misleading disclosures are not permitted.

If accepted into the program, you may be given limited permission to use approved logos, images, product names, and marketing materials solely for promoting My Devilish Desires through the affiliate program. You may not modify our logos or trade marks without permission, create misleading pages or accounts that appear to be official brand channels, or register domains, usernames, or social handles that copy or closely imitate our brand. All intellectual property rights remain owned by My Devilish Desires or its licensors.

Affiliates may not use their own affiliate code or link for personal purchases unless expressly permitted by us in writing. We may refuse commission on self-referrals, orders placed by the affiliate’s own household where abuse is suspected, orders generated through fake accounts, bots, or incentive abuse, and bulk buying or resale activity designed primarily to exploit affiliate commission.

We may suspend, restrict, or terminate your affiliate account at any time, with or without notice, if you breach these Terms & Conditions, your conduct creates legal, payment, platform, or reputational risk, your promotional methods are misleading, non-compliant, or harmful to the brand, or fraud, abuse, or unusual activity is suspected. If your account is terminated for breach, fraud, or abuse, unpaid commissions may be withheld, cancelled, or reversed.

We may amend these Terms & Conditions, commission rates, discount offers, tracking methods, product exclusions, campaign rules, or tier structures at any time. Updated terms will take effect once posted on our website or otherwise communicated to affiliates.

To the maximum extent permitted by law, My Devilish Desires will not be liable for indirect or consequential losses, loss of profits, data, goodwill, or opportunity, or technical tracking failures, platform outages, payment delays, or third-party system errors. Our total liability arising from the affiliate program will not exceed the amount of commission properly due and unpaid to you for the relevant claim period.

These Terms & Conditions are governed by the laws of England and Wales, and the courts of England and Wales shall have exclusive jurisdiction unless otherwise required by applicable law.
